Terms of Service

These Terms of Service govern your access to and use of tradiesbio.au and all services, features, and content provided by Tradies Bio® ("the Platform", "we", "us", "our"). By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Registered Trademark & Intellectual Property

Tradies Bio® is a registered trademark — TM No. 2408794, registered with IP Australia. The name "Tradies Bio", the T-mark logo, the tagline "BUILDING YOUR BUSINESS IS OUR BUSINESS", and all associated branding are protected under Australian trademark law.

All content on the Platform — including but not limited to: page copy, feature descriptions, tool names, template wording, email content, the changelog, risk register frameworks, SWMS structure, and platform design — is protected by copyright. Copyright is owned by Stephen Pearce, Founder, Tradies Bio®. All rights are reserved.

Nothing in these Terms grants you any right, title, or licence to use any trademark, logo, or other proprietary information belonging to Tradies Bio® without prior written consent.

2. Prohibited Conduct — No Scraping, Cloning, or Reproducing

You must not, under any circumstances:

• Scrape, crawl, index, or extract any content from the Platform by automated means;
• Clone, replicate, or reproduce the Platform or any substantial part of it for any commercial or non-commercial purpose;
• Copy, redistribute, republish, or exploit any text, code structure, feature design, template, or content from the Platform without prior written consent;
• Use the name "Tradies Bio", the T-mark, or any confusingly similar name or mark in connection with any product, service, or business;
• Reverse-engineer, decompile, or attempt to extract source code from the Platform;
• Use the Platform to build a competing product or service;
• Access the Platform through any means other than the interfaces we provide.

Any breach of this clause may give rise to civil liability under Australian trademark, copyright, and competition law, and we reserve the right to seek injunctive relief and damages without notice.

3. Eligibility & Registration

The Platform is available to licenced Australian tradespeople who hold a current trade licence and a valid Australian Business Number (ABN). By registering, you confirm that:

• You hold a current trade licence issued by a relevant Australian authority;
• Your ABN is active and registered with the Australian Business Register (ABR);
• You are at least 18 years of age;
• All information you provide during registration is accurate and current.

We verify ABNs in real time against the ABR at the point of registration. Providing a false ABN or trade licence will result in immediate account termination.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You must not share your account with any other person. You are responsible for all activity that occurs under your account. Notify us immediately at info@tradiesbio.au if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate any account at our discretion, with or without notice, for breach of these Terms or for any conduct we deem harmful to the Platform or its users.

5. Free Access — No Current Charge

The Platform is currently provided free of charge to eligible licenced tradies with an active ABN. "Free" means no subscription fee, no credit card, and no hidden charges for features currently available. We reserve the right to introduce pricing in the future, and will provide reasonable notice to existing users before any paid tier is introduced. "Free" does not mean "permanently free" and does not constitute a contractual commitment to provide the service without charge in perpetuity.

6. Compliance Vault, Uploaded Documents & No Verification of Credentials

You retain ownership of documents you upload to your Compliance Vault. By uploading, you grant us a limited, non-exclusive licence to store and display those documents to you within your account. We do not share your documents with third parties. You are responsible for ensuring the accuracy and currency of all documents you upload.

Important — No Independent Verification: Tradies Bio® does not independently verify, authenticate, or validate any licences, insurances, qualifications, or other documents uploaded to the Platform. All information displayed on a tradie's public profile is entered by the tradie themselves. It is each tradie's sole responsibility to ensure that their details — including trade licences, public liability insurance, and other credentials — are accurate, current, and compliant with all applicable Australian laws and regulations.

Tradies Bio® makes no representation and gives no warranty as to the accuracy, currency, or legitimacy of any information entered or uploaded by a tradie. Any person relying on information displayed on a tradie's public profile does so at their own risk. Tradies Bio® and Stephen Pearce accept no liability for any loss, damage, or harm arising from reliance on tradie-supplied information.

Maximum upload sizes: 5 MB per document, 2 MB per logo image. Accepted formats: PDF, JPG, PNG only.

7. AI Co-Pilot — Important Notice

The Tradies Bio® AI Co-Pilot provides general information and drafts communications to assist your business operations. It does not provide legal, financial, taxation, or professional advice. Responses generated by the AI Co-Pilot should be reviewed before relying on them. We strongly encourage you to discuss risk registers, tax questions, CGT concessions, and business strategy with your qualified accountant or business adviser.

The AI Co-Pilot is not a substitute for professional advice. No warranty is made as to the accuracy or completeness of any AI-generated content.

8. Limitation of Liability

To the maximum extent permitted by Australian consumer law, Tradies Bio® is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or meet your specific requirements.

In no event will Tradies Bio® or Stephen Pearce be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes any guarantee or right that cannot be excluded under the Australian Consumer Law.

9. Third-Party Services

The Platform integrates with third-party services including Stripe (payments), the Australian Business Register (ABN verification), and AI providers. Use of these services is subject to their own terms and privacy policies. We are not responsible for the conduct of third-party services.

10. Changes to These Terms

We may update these Terms at any time. The effective date at the top of this page will be updated when changes are made. Continued use of the Platform after any change constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
