Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tradies Bio® platform, including the public website at https://tradiesbio.au/, the personal tradie dashboard, the Progressive Web App (PWA), and all integrated features such as Google Calendar, AI Co-Pilot, phone enquiries, and customer management tools (collectively, the "Platform"), operated by Tradies Bio Pty Ltd (ABN: 13 673 618 990) ("we", "us", or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. If you have questions, contact us at info@tradiesbio.au.

1. Acceptance of Terms

By creating an account, accessing the Platform, or using any feature of the Platform — including filling out a public tradie profile, submitting or receiving customer enquiries, or connecting a third-party service — you confirm that:

• You have read and understood these Terms;
• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement; and
• You agree to be bound by these Terms and our Privacy Policy.

2. Permitted Use

Tradies Bio® is a business platform designed for licensed Australian tradies. You may use the Platform only for lawful purposes and in accordance with these Terms. Permitted uses include:

• Creating and maintaining a public tradie business profile;
• Receiving and managing customer enquiries;
• Using AI and voice tools to assist with business communications;
• Connecting supported third-party services (such as Google Calendar) for business management; and
• Accessing business tools, resources, and content provided on the Platform.

You must not:

• Use the Platform for any unlawful, fraudulent, or deceptive purpose;
• Upload or transmit content that is false, misleading, defamatory, or infringes third-party rights;
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or our systems;
• Use automated tools, bots, or scrapers to access or extract content from the Platform without our written consent;
• Resell, sublicense, or commercially exploit the Platform or its content without our prior written approval; or
• Interfere with the security, integrity, or availability of the Platform.

3. Tradie Responsibilities — Accuracy of Business Information

If you register as a tradie on the Platform, you are solely responsible for the accuracy, completeness, and currency of all information you provide, including but not limited to:

• Your Australian Business Number (ABN);
• Trade licences and licence numbers;
• Certificates of currency for insurance;
• Business name, contact details, and service descriptions; and
• Any other credentials displayed on your public Bio page.

You agree to update your profile promptly if any of your business information changes, including if a licence expires, insurance lapses, or your ABN status changes.

4. Account Registration and Security

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate and complete registration information;
• Maintain the confidentiality of your login credentials;
• Notify us immediately at info@tradiesbio.au if you suspect unauthorised access to your account; and
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, used fraudulently, or used in violation of these Terms.

5. Intellectual Property

All content on the Platform — including text, graphics, logos, software, and the Tradies Bio® brand (registered trademark TM No. 2408794) — is owned by or licensed to Tradies Bio Pty Ltd and is protected by Australian and international intellectual property laws.

You retain ownership of content you upload to the Platform (such as photos and business descriptions). By uploading content, you grant Tradies Bio Pty Ltd a non-exclusive, royalty-free, worldwide licence to display and use that content solely to operate and provide the Platform.

You must not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written consent.

6. Third-Party Services

The Platform integrates with third-party services, including but not limited to Google Calendar, Twilio (phone services), OpenAI (AI features), and Stripe (payments). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Tradies Bio Pty Ltd and its officers, directors, employees, and agents are not liable for any:

• Loss of profits, revenue, data, goodwill, or business opportunity;
• Indirect, incidental, special, consequential, or punitive damages;
• Damages arising from your reliance on information provided by another tradie, including credentials, licences, or insurance details displayed on a tradie's profile;
• Losses arising from unauthorised access to or alteration of your account or content; or
• Interruptions to or unavailability of the Platform.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other non-excludable statutory protections.

Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising out of or in connection with your use of the Platform is limited to the amount you paid us (if any) in the three months preceding the event giving rise to the claim.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not verify or endorse any tradie's qualifications, licences, insurance, or work quality. Any engagement with a tradie is at your own risk.

9. Account Termination

You may close your account at any time by contacting us at info@tradiesbio.au. Upon termination, your public profile will be removed from the Platform.

We reserve the right to suspend or permanently terminate your account, with or without notice, if you:

• Violate these Terms;
• Provide false or misleading business information;
• Engage in fraudulent or unlawful conduct; or
• Take actions that harm other users, customers, or the Platform.

Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will survive the termination of your account.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or via a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
